1. OVERVIEW

We collect Personal Information (defined below) that you voluntarily provide through our Website and Services, using it for the purposes you intended (see Information We Collect Directly From You and How We Use Your Information). We also automatically collect information, which may include Personal Information, for advertising, analytics, and to deliver our Services (see Information We Collect Automatically and How We Use Your Information). Additionally, we process Service Data on behalf of our clients per our agreements with them. By using our Website or Services, you agree to this Privacy Policy. If you do not agree, please refrain from using our Website or Services or providing Personal Information.

Our Website and Services are hosted in the United States, where all related servers are located. Data stored in the U.S. may be subject to lawful requests by U.S. courts or law enforcement. Our Website and Services are intended for U.S.-based users. For inquiries, see the Contact section below.

2. INFORMATION WE COLLECT DIRECTLY FROM YOU

We collect information, including Personal Information, when you voluntarily provide it—such as through emails or interactions with our Website or Services. “Personal Information” refers to data that identifies, relates to, or can reasonably be linked to you, also known as “personal data” or “personally identifiable information” under applicable laws. Providing this information is entirely voluntary.

Categories of Personal Information we may collect include:

  • Identity Data: Name or other identifiers

  • Contact Data: Email address or phone number

  • Marketing and Communications Data: Preferences for receiving marketing from us

We may also collect other information you directly provide during interactions.

3. INFORMATION WE COLLECT AUTOMATICALLY

We, our service providers, or third-party partners may automatically collect information, including Personal Information, when you visit our Website or use our Services, using cookies and similar tracking technologies. While some data (e.g., device or cookie IDs) may not directly identify you, it may still be considered Personal Information under applicable laws.

Methods of automatic collection include:

  • Cookies and Similar Technologies: We or our vendors may use cookies, clear GIFs, web beacons, or tags to collect usage data. Cookies are small files placed on your device to enhance your experience, capturing data like websites visited before and after ours, browser type, IP address, pages viewed, links clicked, and geo-IP data. We use this to personalize your experience and improve our Services.

  • Clickstream Data: This tracks your online activity, such as the type of device and browser used, or the website you visited before ours. We use clickstream data in aggregate to analyze visitor behavior, navigation patterns, and to optimize our Website and Services.

  • Site and Platform Analytics: We partner with third-party providers like Google Analytics to track user interactions. Google Analytics uses cookies to analyze usage, storing data (including your IP address) on U.S. servers. Google uses this to evaluate Website activity, compile reports, and provide related services. You can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout/. By using our Services and accepting cookies, you consent to Google’s data processing as described.

4. HOW WE USE YOUR INFORMATION

  • To provide and manage our Website, Services, and client services

  • To deliver relevant content, products, and offerings based on your interests

  • To analyze trends, infer preferences, and improve our affiliates’ and partners’ products

  • To market our goods and services, or those of affiliates, partners, or third parties

  • To provide targeted advertising for products and services of interest

  • To respond to law enforcement requests or comply with legal obligations

  • To ensure the safety, security, and integrity of our Website, Services, and technology assets

  • For internal research, technological development, and service enhancement

  • To detect and address security incidents, fraud, or illegal activity

  • To investigate violations of laws, regulations, or our policies

  • In connection with business transactions like mergers, sales, or bankruptcy proceedings

  • To respond to your inquiries and add you to mailing lists

  • For purposes you specifically consent to

For Service Data, we process it solely to provide Services to our clients. We may supplement your Personal Information with data from other sources (online or offline). Non-Personal Information (e.g., aggregated or de-identified data) may be used or shared for any lawful purpose, unless otherwise stated in this Policy. If Non-Personal Information is combined with Personal Information, the combined data is treated as Personal Information. Vendors and subcontractors may access your Personal Information only to perform services for us and are not permitted to use it for their own benefit.

5. HOW WE SHARE YOUR INFORMATION

We may share your Personal Information and other data in the following cases:

  • Service Providers/Vendors: With third parties providing services like hosting, data analysis, IT support, customer service, email delivery, auditing, and anti-fraud monitoring, who may access necessary Personal Information to perform their roles.

  • Legal Compliance and Rights Protection: When necessary to comply with applicable laws, legal processes, or government requests; enforce our Terms and Conditions; protect our operations, rights, privacy, safety, or property (or those of our affiliates, you, or others); or pursue remedies and limit damages.

  • Business Transfers: With third parties during corporate restructuring, acquisitions, or divestitures.

  • Cross-Device Matching: We may match your devices using collected data to display targeted ads across devices, unless you opt out (see Your Choices).

  • Aggregated or Non-Personal Information: With third parties like business partners for purposes such as improving your experience or conducting market research.

If you consent to additional uses, we may share your Personal Information accordingly.

6. INTEREST-BASED ADVERTISING

We may use collected information (alone or combined with third-party data) to deliver targeted ads for our products or third-party offerings on our Website, Services, or other sites. For example, if you search for a product, we may display related ads on other websites you visit. We partner with third parties who collect data across channels (online and offline) to provide relevant advertising, using cookies or device IDs to recognize you across devices and platforms (e.g., computers, mobile devices, Smart TVs) for advertising, analytics, and reporting. To opt out of interest-based ads or cross-device matching, see Your Choices.

7. SECURITY

We prioritize the security of your information, using Secure Sockets Layer (SSL) encryption for data transmission when feasible. However, due to the internet’s open nature, we cannot guarantee protection against unauthorized access (e.g., by hackers). By using our Services, you assume this risk. We implement reasonable physical, electronic, and managerial safeguards to protect your data, limiting access to employees who need it for their duties. If you believe your interaction with us is no longer secure, contact us immediately at LotusSociety@curated-communities.com.

8. DATA RETENTION

We retain your information as long as your inquiry or use of our Services is active, and for a reasonable period thereafter, per our standard procedures or legal obligations (e.g., to resolve disputes or enforce agreements). Anonymous or aggregated data may be retained and used even after deletion of your Personal Information. We are not liable for disclosures due to errors or unauthorized third-party acts.

9. PROTECTION FOR CHILDREN

Our Website and Services are for users aged 18 and older. We do not knowingly collect Personal Information from minors. If we learn that we’ve collected data from a child under 13, we will take reasonable steps to delete it. If you believe we have such information, contact us at LotusSociety@curated-communities.com.

10. YOUR CHOICES

We offer options for managing how your information is used and shared:

  • Opting Out of Marketing: Unsubscribe from marketing emails via the provided link or by emailing LotusSociety@curated-communities.com. Note that opting out may limit access to certain Services.

  • Interest-Based Advertising and Do Not Track: Third parties may collect data about your online activities across sites to deliver targeted ads. Opt out via the Network Advertising Initiative (http://www.networkadvertising.org/choices/) or Digital Advertising Alliance (http://www.aboutads.info/choices). Opting out means you’ll see general ads, not tailored ones, and must be done on each device/browser. For cross-device matching, opting out on one device (“Opted-Out Device”) prevents us from using its data for interest-based ads on other devices, and vice versa.

11. NEVADA PRIVACY RIGHTS

Nevada residents may request that we not sell their covered information (per N.R.S. 603A). We do not sell such information, but you may submit a request at LotusSociety@curated-communities.com.

12. YOUR CALIFORNIA PRIVACY RIGHTS

Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act, California residents have specific rights regarding their Personal Information. When we process Service Data for clients as a “service provider,” we do so only as directed by the client. To exercise CCPA rights over such data, please contact the relevant business that collected it from you.

Under California’s “Shine the Light” law (Civil Code Section 1798.83), residents may request details about personal information shared with third parties for direct marketing in the prior year. To request this, or to opt out of such sharing, email us at LotusSociety@curated-communities.com.

13. CHANGES TO POLICY

We may update this Privacy Policy at our discretion, with changes applied prospectively. We encourage periodic review of this policy on our Website. Continued use of our Website or Services after changes indicates your acceptance.
